1. Agreement to Terms
By accessing our website and utilizing our development services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, please do not use our services.
2. Service Scope and Deliverables
We provide software development, design, and AI solutions. The specific scope, timelines, and deliverables for your project will be detailed in a formal Proposal and Master Services Agreement (MSA) prior to project kick-off.
3. Anti-Fraud & Security Deposit Guarantee
To build trust and eliminate risk for our clients, our engagements operate under strict financial safeguards:
- 100% Money-Back Guarantee: If we completely fail to deliver the initial agreed-upon minimum viable product (MVP) scope within the grace period defined in your contract due to our fault, you are entitled to a full refund of your initial deposit.
- Security Deposits: Projects typically start with a security deposit (e.g., 20-30%). This secures your engineering resources. We do not demand full upfront payments for large-scale projects; payments are tied to verified milestones.
- Verifiable Identity: We establish formal legal contracts (NDAs, MSAs) with all clients, ensuring full legal recourse and total transparency.
4. Intellectual Property
Upon final payment for a milestone or project completion, all intellectual property rights to the custom code written specifically for your project are fully transferred to you. Pre-existing proprietary libraries or third-party open-source tools remain governed by their respective licenses.
5. Client Responsibilities
The timely delivery of projects relies on mutual cooperation. Clients are expected to provide necessary access, materials, and approvals in a timely manner. Delays on the client's end may affect the final delivery timeline.
6. Modifications and Maintenance
Post-deployment bug fixes are typically covered under a specific warranty period defined in your contract. Ongoing maintenance, hosting, and new feature requests are handled via separate Service Level Agreements (SLAs).
7. Limitation of Liability
While we engineer software to the highest standards, 11thcode.in shall not be held liable for indirect, incidental, or consequential damages resulting from the use or inability to use the developed software, outside of the specific monetary guarantees outlined in Section 3 and your contract.
